1. Who we are
"Studio Bananas," "we," "us," and "our" refer to Studio Bananas Group, with its headquarters in Washington, D.C., United States, and operations conducted internationally. Our services are delivered under four divisions: SB Marketing (marketing), SB Intelligence (AI & automation), SB Financial (payment solutions), and SB Capital (capital & financing advisory).
2. Our services & our role
We provide marketing strategy, AI and automation, and advisory introductions for payment processing and financing. Our role differs by division, and it's important you understand it:
- SB Financial (payments). Payment processing is provided by our partner PaySys. Studio Bananas Group is an approved affiliate of PaySys Inc., authorized to market and promote its services — we are not a bank, payment processor, money transmitter, or card issuer. Any merchant agreement is between you and PaySys (and the relevant acquiring bank).
- SB Capital (financing). Financing is arranged through our partner Brookmont Capital Ventures, a capital markets advisory firm. Studio Bananas Group is an approved affiliate of Brookmont Capital Inc., authorized to market and promote its services — we are not a lender, mortgage broker, or financial, tax, or investment advisor. Nothing on this site is an offer of credit or a commitment to lend, and all financing is provided by third-party lenders subject to their underwriting.
- SB Marketing & SB Intelligence. Marketing, AI, and automation engagements are governed by the separate written proposal or statement of work we agree with you, which controls in the event of any conflict with these Terms.
3. Security & compliance
Card payments arranged through SB Financial are handled on PCI DSS v4.0–compliant infrastructure provided by PaySys, which maintains SOC 2 controls as the payment processor. Studio Bananas Group does not store, process, or transmit full cardholder data on its own systems, and does not retain complete card numbers. Compliance certifications referenced here are held and maintained by the respective service providers; we can share current attestations on request.
4. Eligibility & lawful use
You must be at least 18 years old and able to form a binding contract to use this site or engage us. For regulated or high-risk verticals — including adult and gaming/iGaming — services are provided only where lawful in your jurisdiction, and approvals depend on the partner's underwriting, your licensing, and applicable age and consumer-protection rules (for example, 18+ or 21+ requirements where they apply). You are responsible for operating in compliance with all laws, card-network rules, and licensing that govern your business.
5. Your responsibilities
- Provide accurate, current, and complete information when you contact us or apply through a partner.
- Use the site and services only for lawful purposes.
- Maintain the licenses, registrations, and consents your business requires.
- Not misuse the site (no scraping, interference, malware, or unauthorized access).
6. Fees
Fees for marketing, AI, and automation work are set out in your written proposal or statement of work. For SB Financial and SB Capital introductions, Studio Bananas Group is typically compensated by the partner (PaySys or Brookmont) — not by you — and we will disclose any compensation arrangement that the law requires us to disclose. Processing, interchange, and financing costs are set by the respective providers.
7. Intellectual property
The site, its content, and the Studio Bananas, SB Marketing, SB Intelligence, SB Financial, and SB Capital names and marks are owned by Studio Bananas Group or used under license. Deliverables created for a client are governed by the relevant statement of work; absent other terms, ownership transfers on full payment. You may not copy, reproduce, or reuse site content without permission.
8. Third-party services & links
We work with and link to third parties, including PaySys, Brookmont Capital Ventures, and analytics or scheduling tools. We are not responsible for the content, products, or practices of third parties, and your use of their services is governed by their own terms and policies.
9. Confidentiality
Information you share with us in the course of an engagement is treated as confidential and used only to evaluate and deliver services, except where disclosure is required by law or necessary to a partner to process your request.
10. No guarantee of results
Marketing, automation, payment, and financing outcomes depend on many factors outside our control. Any figures, case studies, or estimates on this site (including the savings calculator and representative transactions) are illustrative, not promises. We do not guarantee specific results, approvals, rates, or returns.
11. Disclaimers & limitation of liability
The site and its content are provided "as is" without warranties of any kind, to the fullest extent permitted by law. To the maximum extent permitted by applicable law, Studio Bananas Group will not be liable for indirect, incidental, special, or consequential damages, and our total liability arising from an engagement is limited to the fees you paid us for that engagement. Nothing in these Terms limits liability that cannot be limited under applicable law.
12. Indemnification
You agree to indemnify and hold Studio Bananas Group harmless from claims arising out of your breach of these Terms, your misuse of the site, or your violation of any law or third-party right.
13. Privacy & data protection
Our handling of personal data is described in our Privacy Policy. Because we operate internationally and are based in the EU, we apply GDPR principles to personal data, including for users in the European Economic Area and the United Kingdom. If you contact us, we use your details only to respond and to follow up about your enquiry — we do not sell your data.
14. Governing law
These Terms are governed by the laws of the District of Columbia, United States, without regard to conflict-of-laws rules. Where mandatory consumer-protection or data-protection laws of your country of residence apply (including in the EU/EEA and UK), those protections continue to apply to you.
15. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date above reflects the current version, and material changes will be posted on this page. Continued use of the site after changes means you accept them.
